June 29, 2024The Monfalcone Islamic centers case shows how religious freedom, land-use rules and building safety can come into tension. The TAR had upheld the associations’ appeals; the Council of State later overturned those decisions.
The dispute over Islamic prayer spaces in Monfalcone became one of the most debated cases involving religious freedom and urban planning. It involved the Darus Salaam Islamic Cultural Center, the Baitus Salat association and the municipality led by Anna Maria Cisint, generating several proceedings before the administrative courts.
The case was often portrayed as a political clash between the mayor and the Muslim community. A complete account must distinguish the different judicial stages: the first ruling by the Friuli Venezia Giulia Regional Administrative Court, the subsequent interim decisions and, above all, the Council of State judgments of 2 April 2025.
The Municipality’s Orders
The dispute arose from municipal orders challenging the permanent use of certain properties as collective prayer spaces, where the building permits referred to other uses. The orders addressed, among other issues, change of use, occupancy certification and the impact of attendance on safety, traffic and public services.
The Islamic associations challenged the orders, arguing that the municipality had not demonstrated any concrete increase in urban load or incompatibility with planning rules. They also warned that land-use rules risked being applied disproportionately to spaces used for Muslim worship.
The TAR’s First Decision
In June 2024, the Friuli Venezia Giulia TAR upheld some of the associations’ appeals. In the first-instance court’s view, the formal difference between the use stated in the building permits and the use actually carried out was not, by itself, enough to justify enforcement action by the municipality.
The TAR held that the administration should have demonstrated a concrete incompatibility with the planning instrument or an actual impact on traffic, safety, services and public facilities. In the absence of an adequate investigation, the orders were annulled.

The Council of State Changes the Outcome
On 2 April 2025, the Second Section of the Council of State upheld the Municipality of Monfalcone’s appeals and overturned the TAR decisions concerning the Islamic centers. Judgments nos. 2821, 2822 and 2823 dismissed the first-instance appeals and upheld the legality of the challenged municipal orders.
The central point of the judgments is not a denial of religious freedom. The Council of State reaffirmed that freedom of worship must be exercised in compliance with planning and building law, including occupancy and safety requirements. A building permanently used for collective prayer may have an objective impact on the surrounding area and must therefore be assessed according to the rules applicable to its actual function.
Il pronunciamento ha dunque corretto la lettura del TAR: la questione non poteva essere risolta guardando soltanto alla mancanza di una prova puntuale dell’aumento del carico urbanistico nelle ordinanze, ma doveva considerare l’uso stabile dell’immobile come luogo di culto e l’insieme degli obblighi edilizi e amministrativi collegati.
Religious Freedom and Planning Rules
The case does not justify presenting religious freedom and planning law as opposites. Article 19 of the Italian Constitution protects the right to profess one’s faith collectively, but this protection does not remove rules on building safety, capacity, occupancy certification or planning compatibility.
Allo stesso tempo, la disciplina urbanistica non può essere utilizzata come strumento discriminatorio. La verifica deve riguardare le caratteristiche effettive dell’edificio e dell’attività, con criteri proporzionati e applicati senza differenze legate alla confessione religiosa. Il vero punto di equilibrio consiste nel rendere compatibili entrambe le esigenze: il diritto al culto e la sicurezza di chi frequenta i luoghi di preghiera.
The Political Significance of the Case
Monfalcone is also a political case. Public statements and the broader confrontation between the administration and the Muslim community helped turn a building dispute into a national debate about Islam in Italy. For this reason, it is important to distinguish judgments about the mayor’s policies from the technical content of the rulings.
Le decisioni del Consiglio di Stato non stabiliscono che ogni spazio di preghiera sia illegittimo, né autorizzano i Comuni a vietare il culto islamico. Stabilisco invece che l’uso stabile di un immobile come luogo di culto deve essere verificato nel quadro urbanistico ed edilizio vigente e che la libertà religiosa non sostituisce i titoli e i requisiti necessari per l’utilizzo sicuro degli spazi.
A Case That Still Matters
The Monfalcone case remains instructive because it reveals two opposite risks. On the one hand, invoking religious freedom cannot create an automatic exemption from rules protecting safety and public welfare. On the other, planning enforcement should not become an indirect way of making collective religious practice impossible.
The most important lesson is procedural: administrations must conduct precise investigations, communities must ensure transparency and compliant premises, and courts must assess constitutional freedom, building law and the concrete circumstances together. The first instance offered one answer in Monfalcone; the Council of State gave another, and the later ruling is now the main reference for understanding the case.
